Certifly IA Terms of Service (2025)
By using this website and submitting a request for services, you agree to the following Terms of Service, which serve as a legal agreement between you (the user or client) and Certifly IA. These terms are designed to protect all parties, define the scope of our services, and set the expectations for how Certifly IA operates.
Certifly IA is a mobile FAA Inspection Authorization (IA) coordination service that connects aircraft owners with licensed FAA IAs and A&P mechanics for airworthiness inspections and related services. We do not provide unauthorized repair services or unregulated maintenance actions. Our inspections are conducted in accordance with FAA regulations under 14 CFR Part 43 and applicable FAA orders and airworthiness directives. Submission of a service request via this website does not guarantee scheduling or service. All requests are subject to approval based on availability, aircraft type, inspection requirements, and location. Certifly IA reserves the right to decline or reschedule services at its sole discretion.
Clients must provide accurate, truthful, and complete information when requesting service. Failure to do so may result in denial of service, cancellation, or report invalidation. Aircraft must be safe, accessible, and inspection-ready. Certifly IA is not responsible for delays caused by hazardous environments, incomplete logbooks, or unavailable documentation. The client acknowledges that inspections reflect the aircraft’s condition only at the time of the service and do not guarantee future airworthiness, mechanical reliability, or regulatory compliance beyond that point. Certifly IA does not assume responsibility for mechanical failures or FAA enforcement actions resulting from post-inspection issues. Inspection findings may include recommendations to ground an aircraft for safety or regulatory reasons. In such cases, Certifly IA or its contractor may immediately halt the inspection. Certifly IA is not liable for costs, missed flights, or losses resulting from such determinations.
Certifly IA operates as a dispatch model and may assign qualified independent contractors to perform services. These individuals are not employees of Certifly IA. While we verify credentials and screen for FAA license validity, Certifly IA is not responsible for the independent acts, omissions, or conduct of subcontracted personnel. Clients agree that any disputes involving contractors must be addressed directly with Certifly IA for coordination purposes, but Certifly IA disclaims liability for services performed beyond the agreed scope. Any recommendations made by Certifly IA or its affiliates are advisory and do not substitute for compliance with FAA rules and airworthiness standards. It is the responsibility of the aircraft owner or operator to comply with all applicable regulations, including 14 CFR §91.403 and §91.405.
Clients agree to indemnify, defend, and hold harmless Certifly IA, its owner(s), officers, agents, and affiliates from any liability, loss, damages, claims, or expenses—including legal fees—arising out of or related to their use of our services, the results of an inspection, or reliance on inspection documentation. We are not liable for third-party repairs, maintenance recommendations, or mechanical failures that occur after our inspection is complete.
Certifly IA may operate in varying geographic locations. Travel fees may apply depending on inspector location, fuel costs, and logistical complexity. Clients will be informed of applicable fees prior to confirmation. Cancellations must be made at least 48 hours prior to the appointment to avoid additional charges. Certifly IA reserves the right to cancel or reschedule due to illness, weather, FAA restrictions, or availability limitations.
Payment is due per the terms stated on each invoice. Reports and certifications may be withheld until payment is received. Failure to pay may result in cancellation of future services and legal recovery efforts. Certifly IA does not currently collect or process payments directly through this website. All billing arrangements are handled separately after service is confirmed.
Force majeure: Certifly IA shall not be held liable for any delays, cancellations, or failures to perform caused by events beyond our control, including but not limited to natural disasters, illness, FAA rule changes, travel interruptions, internet outages, or other unforeseen circumstances. All intellectual property presented on this site—including logos, documents, checklists, and branding—is owned by Certifly IA and may not be reproduced or reused without written permission. Unauthorized use will be prosecuted under applicable U.S. intellectual property laws.
By submitting a service request, you agree to receive digital communications from Certifly IA, including updates, estimates, reports, and scheduling confirmations via email, phone, or text message. Your personal information is collected only for the purpose of coordinating service and is never sold to third parties. Data is securely stored and handled in accordance with the privacy principles outlined in the Federal Trade Commission Act (15 U.S.C. §§ 41–58).
In accordance with the Federal Arbitration Act (9 U.S.C. §§ 1–16), all disputes arising from or related to your use of Certifly IA services shall be resolved by binding arbitration conducted in Washington State under the rules of the American Arbitration Association (AAA). You and Certifly IA waive the right to bring or participate in any class action lawsuit, mass arbitration, or representative proceeding. Each party agrees to arbitration in their individual capacity only, and not as a plaintiff or class member. The arbitrator’s decision shall be final and enforceable in any court of competent jurisdiction.
These Terms of Service may be modified at any time without prior notice. Continued use of the website or services constitutes agreement to the updated version. Any legal dispute not resolved through arbitration shall be brought in a court of competent jurisdiction in the State of Washington. The laws of the State of Washington, in accordance with applicable federal regulations, will govern this agreement.
